Tourism New Zealand Terms & Conditions (including Privacy Policy)
Introduction
Tourism New Zealand (TNZ) is an Agency for the purposes of the New Zealand Privacy Act 1993. TNZ is committed to protecting the privacy of personal information users might provide via the newzealand.com website. Accordingly, all personal information you supply to TNZ will be treated in accordance with that Act. This privacy policy explains how TNZ manages personal information and data protection.
Scope of these Terms and Conditions
These Terms and Conditions cover the newzealand.com/travel site with the following exceptions:

Collection of Personal Information
TNZ collects and holds information about you and other website users, including:
- Personal information provided voluntarily when completing a TNZ survey, entering a search query, or entering other details into the website.
- Website usage and traffic information through tracking users' behaviour, clickstream data and http data.
- Where you create a profile for Travel Planner, your home country, email address and name. This enables TNZ to store Travel Planner information between your visits to the website.
- Where you wish to send e-postcards or your Travel Planner to friends, your friend's name and email address.
- Where you wish to get help from a Travel Partner or Airline through Travel Planner, your name, email address, contact phone number/s, address, possible travel dates and travel preferences.
No attempt is made by TNZ to identify individuals without their knowledge. In most circumstances, you can visit the newzealand.com website without telling TNZ who you are or revealing any information about yourselves. Whenever the identity of a user is recorded, we will clearly indicate the purpose of the request before the information is requested.
Use of Personal Information
TNZ collects personal information for the following purposes:
- To enable TNZ to provide its services to you and to improve its service.
- Research and development.
- Completion and support of current activity.
- To send e-postcards to your nominated friends. TNZ has no control over the use of information sent using the "email a friend" functionality.
- To analyse website usage, trends and statistics.
- Where Travel Planner is used, to email you with a new password where you have forgotten your login or password details.
- To supply you with further information concerning products and services in which you have indicated an interest, for example help with planning your trip to New Zealand from a Travel Partner or Airline.
- Any other use that you authorise.
Details you provide may be used to supply you with further information concerning products and services in which you have indicated an interest. In order to supply this information, TNZ may supply your details to suppliers of the relevant products or services. If you have indicated an interest in receiving more general information about New Zealand, TNZ may supply your details to other businesses or organisations who may be able to provide you with further information. If you decide that you no longer wish to have your name on the TNZ list, you can contact TNZ at newzealand.com@tnz.govt.nz and TNZ will delete your record.
TNZ will not use your contact information provided for marketing purposes.
Disclosure of Personal Information
TNZ will not sell, or allow third parties access to your personal information without your approval. However, from time to time TNZ may disclose:
- Site user location information to other content providers such as Akamai, who will then provide you with access to that information.
- Log files to companies such as Intersect Communications, who will then analyse the information for trends and statistics on the website. The information is then discarded.
- Log files to companies such as Shift, who will then analyse the click paths for trends and statistics. The information is then discarded.
- Information to other third parties, provided TNZ has your prior authorisation, to enable TNZ to process the information for specific purposes.
Otherwise your personal information will not be passed on to any other third party unless it is authorised or required by law. Disclosures may include the transfer of your personal information between countries.
Access to and Correction of Personal Information
You may request access to and correction of your information at any time. If you fail to provide information, or supply incorrect information, TNZ may not be able to provide you with some services. If you wish to access or correct your information you should contact TNZ's privacy officer.
Other Websites
newzealand.com/travel does offer links to other websites, however, TNZ is not affiliated with those websites and does not accept responsibility or liability for the content and privacy practices of those websites, and/or the reliability of the information published on those websites.
Cookies
This site uses cookies to provide you with a better service. Cookies are small pieces of information stored by your browser on your computer hard drive. Cookies help TNZ provide a better website by letting TNZ monitor what's working and what isn't through working site traffic analysis. Accepting a cookie does not give TNZ access to the user's computer or personal information under any circumstances. You may configure your web browser to not accept cookies, however you may experience a loss of functionality as a result.
Liabilities
Tourism New Zealand is not liable for the following:
- Loss of Travel Planner data from the site servers through accident or hacking.
- Loss of Travel Planner data because of network interruptions or hacking between user and newzealand.com servers.
- Loss of Travel Planner data due to user not creating a Travel Planner account after anonymously collecting.
- Expiry of accounts after 6 months of inactivity by the user.
- Any actions or lack of action by the travel partner or airline in relation to an enquiry.
- Failure of the site server to successfully send Travel Planner to a travel partner or airline, or email to a friend.
- Unauthorised access by anyone to Travel Planner accounts and information where TNZ has taken reasonable care to protect that information.
- Accuracy of information. This is outside the control of TNZ and its partners. Users should contact the operator concerned to confirm information including price, location and availability of services or products.
- The travel partner and airline referral service not being available for all countries.
You are responsible for:
- Keeping your Travel Planner username and password safe.
- Not using the email a friend functionality to spam or harass other email or web users.
- Not on-selling the Travel Planner service or using Travel Planner for profit.

Romantic New Zealand Honeymoon Terms and Conditions

- Introduction: Entrants must read and agree to these terms and conditions ("Terms") before entering this competition. By completing and submitting a Travel Planner itinerary for this competition ("Proposed Itinerary"), entrants confirm that they accept these Terms.
- Organisers: The promoter of this competition is the New Zealand Tourism Board trading as Tourism New Zealand (South Korea), Room 1107-1108, Officia Building, 163 Shinmunno 1ga, Jongno-gu, Seoul, South Korea ("Tourism New Zealand"). The prizes are sponsored by Tourism New Zealand and their partners.(together, the "Organisers").
- Grand Prizes: There is one (1) prize to be won. Grand Prize comprises:
(a) two (2) adult return airfares for travel from South Korea (Incheon) to New Zealand (the "Airfares") for travel by the winner and up one(1) companion of that winner’s choice (together, the "Travellers"), and
(b) five (5) nights’ twin share accommodation as the winner selected in Itinerary, and.
(c) One (1) activity included in itinerary
- Minor Prizes: There are one (1) minor prize to be won. Minor Prize comprises a Luxury Honeymoon Product selected by TNZ for a couple.
- Scope and nature of prizes: Each prize consists solely of the item(s) referred to in clause 3 or 4 above, as the case may be. The prizes are non-assignable, non-refundable, non-negotiable, and (subject to clause 13 below) non-substitutable, whether in whole or in part. Both Grand & Minor Prize are non-transferable. The prizes cannot be exchanged for cash, credit, Air Points Dollars (or other similar benefits), or otherwise, whether in whole or in part. In respect of each Prize:
(a) all other expenses including, without limitation, other accommodation(for longer staying), other activities, other transportation, spending money, meals, tips, insurance (including travel insurance), vaccinations, departure and airport taxes, security taxes, government charges, insurance levies, fuel, fuel surcharges, customs/agriculture fees, and passenger facility charges, shall be the sole responsibility of the Travellers;
(b) the Travellers shall be responsible for obtaining all necessary travel documentation, including passports and visas, where applicable;
(c) no Air Points Dollars (or other similar benefits) will accrue from the Airfares or any other part of a Prize, and the Airfares cannot be upgraded from Economy Class to a different class of travel; and
(d) charges may apply in the event that the Travellers, having booked the Prize flights and accommodation, subsequently wish to change the dates of these bookings.
- Availability and date restrictions: All portions of the Prizes are subject to availability, and may also be subject to date limitations and restrictions during school holidays and peak holiday periods.
- Additional terms: All flights will be subject to participant airline’s general terms and conditions of carriage. In addition to these Terms, the providers of any activities, accommodation, transport, and other goods and services that may form part of the Prizes ("Service Providers") might impose additional terms and conditions in relation to the supply of those goods and services.
- Entries: The competition opens on Tuesday, 24 March, 2009 at 12.00pm (NZST) and closes on Monday, 20 April 2009 at 8.30am (NZST) (the "Competition Period"). Entries must be received by Tourism New Zealand during the Competition Period. Tourism New Zealand assumes no responsibility for any error, omission, interruption, deletion, defect, failure, malfunction, alteration, delay in delivery, operation or transmission, theft, or other circumstance of any kind, which may affect an entry or an entrant’s participation in the competition.
- Entry requirements: Any entry which Tourism New Zealand, in its sole discretion, deems to have manipulated the entry process or to be automated, incomplete, illegible, damaged, mutilated, forged, or otherwise tampered with in any way, will not be accepted. Each entrant must:
(a) not be an employee (or immediate family member of an employee) of the Organisers (or of their respective suppliers, distributors, agents, subsidiaries and related companies);
(b) be at least eighteen (18) years old;
(c) be a Korean citizen, or a foreign resident, residing in Korea;
(d) personally create and submit a Proposed Itinerary using the Macromedia Flash-enabled version of the Travel Planner in the Korean-language area of www.newzealand.com (entries submitted by any other means will not be accepted);
(e) provide all information required when creating his or her Travel Planner profile and when creating the Proposed Itinerary (including his or her correct name, postal address, telephone number, and email address, and a title for the Proposed Itinerary);
(f) submit the Proposed Itinerary during the Competition Period; and
(g) submit only one (1) Proposed Itinerary for this competition.
- No payment necessary: No payment is necessary to enter this competition, but any costs associated with obtaining Internet access in order to visit www.newzealand.com shall be the sole responsibility of the respective entrants.
- Judging: At the conclusion of the Competition Period, all Proposed Itineraries submitted during the Competition Period will be frozen until the judges select the winners (the "Judging Period"). During the Judging Period, entrants will be unable to access or modify their Proposed Itineraries. The judges’ decision is final and no correspondence will be entered into. The judges of this competition are:
(a) Ms. Hee Jeong Kwon, Manager Korea, Tourism New Zealand
(b) Ms Sora Jang, Market Development Coordinator, Tourism New Zealand
- Decisions: Tourism New Zealand’s decisions regarding all aspects of this competition including, without limitation, decisions regarding the eligibility of entries, the conduct of the competition, the interpretation of these Terms, and the allocation of the prizes, are final and no correspondence will be entered into. To the maximum extent permitted by law:
(a) no decisions of Tourism New Zealand may be challenged on any grounds, including (without limitation), due to any alleged or actual failure of Tourism New Zealand to act reasonably, fairly, in good faith, or otherwise in accordance with principles of procedural fairness; and
(b) Tourism New Zealand’s decisions will remain binding and conclusive even if those decisions were allegedly or actually wrong or based on any factual error or otherwise based on any unreasonable, irrational, or irrelevant consideration.
- Changes and substitution: Tourism New Zealand reserves the right to cancel this competition, or to change any condition of this competition, without notice. The Organisers reserve the right to substitute the prizes or any part of the prizes (due to unavailability or for any other reason) with a different item of equal or greater monetary value.
- Announcement of winner: The winners’ names will be published on www.newzealand.com on or about 24 April 2009 (the "Announcement Date"). The winners consent to such publication. Tourism New Zealand will attempt to contact the winners on or about the Announcement Date. For three (3) months after the Announcement Date, the winners’ names may be requested by writing to Tourism New Zealand, Room 1107-1108, Officia Building, 163 Shinmunno 1ga, Jongno-gu, Seoul, South Korea.
- Claiming the prizes: Each Prize winner must, within four (4) weeks of the Announcement Date:
(a) claim his or her prize in person by bringing proof of identity to Tourism New Zealand, Room 1107-1108, Officia Building, 163 Shinmunno 1ga, Jongno-gu, Seoul, South Korea;
(b) book all flights and accommodation forming part of the Prize, otherwise that winner shall be deemed to have forfeited his or her prize, and that prize shall remain the property of the respective Organisers.
- Winners’ companions: In order for the companion of a winners to participate in that winner’s prize, that companion must agree to these Terms—including, without limitation, terms and conditions that apply to the Travellers. If that companion is unable or unwilling to agree to these Terms, that companion shall not be entitled to participate in the Prize, and that winner must select a different companion who is willing and able to agree to these Terms.
- Publicity: The Travellers agree to provide three (3) videos filmed in New Zealand and honeymoon photos, and agree to be available for interviewing and photography, and for other public relations and promotional activities associated with this competition, as required by the Organisers. The Travellers consent to their names, voices, photographs, and likenesses being recorded, reproduced, published, copied, communicated, and otherwise used by the Organisers for advertising and publicity purposes in any television program, video recording, sound recording, or printed or electronic materials throughout the world, in perpetuity, and without the need for any compensation other than the Prize.
- Ownership: This competition, all associated promotional materials, and all entries and Proposed Itineraries (including all copyright and other intellectual property rights that may subsist therein) are the property of the respective Organisers and may be copied, published, adapted, communicated, and used by the Organisers for any purpose (including, without limitation, future promotional, public relations, and sales development activities) without the need to obtain the permission of, or to compensate, any entrant.
- Privacy: Personal information provided by entrants will be stored and used by the Organisers for the purposes of conducting the competition. Personal information of each entrant will be made available to, and used by, the Organisers to provide entrants with information and promotional material relating to New Zealand tourism and travel. An entrant’s personal information may be used for additional purposes (such as other research, promotional, or marketing activities) where that entrant has indicated that his or her personal information may be used for those purposes. Personal information of an entrant will not otherwise be disclosed or used except as required or permitted by the New Zealand Privacy Act 1993 or other applicable laws. An entrant may request access to, or correction of, information about him or her that is held by Tourism New Zealand by contacting Tourism New Zealand, Room 1107-1108, Officia Building, 163 Shinmunno 1ga, Jongno-gu, Seoul, South Korea.
- Warranties: To the maximum extent permitted by law, the Organisers (and their subsidiaries, related companies, employees, contractors and agents) disclaim all guarantees, warranties, and representations of any kind (whether express, implied, or statutory) in respect of this competition, the prizes, and the claiming and use of the prizes.
- Liability: To the maximum extent permitted by law, the Organisers (and their subsidiaries, related companies, employees, contractors and agents) shall not be liable for (and the Travellers shall indemnify the Organisers (and their subsidiaries, related companies, employees, contractors and agents) from and against) any personal injury, loss, damage (whether direct or indirect), cost, or expense howsoever caused (including through negligence or breach of statutory duty) arising out of or in connection with:
(a) this competition, the prizes, or the claiming or use of the prizes;
(b) the acts or omissions of the Organisers; or
(c) any Act of God, or other event or occurrence beyond the control of the Organisers.
- Service Providers: The Travellers acknowledge and agree that the Service Providers are independent contractors of the Organisers and are not the agents or principals of the Organisers. The Organisers (and their subsidiaries, related companies, employees, contractors and agents) shall have no responsibility or liability for any:
(a) acts and omissions of a Service Provider;
(b) non-delivery, default, or cancellation of any part of a prize, by a Service Provider;
(c) inaccurate, incomplete, or out-of-date information supplied by a Service Provider; or
(d) dissatisfaction with any goods or services supplied by a Service Provider.
- Risks: Acceptance and use of the Grand Prize is at the Travellers’ own risk and is their responsibility. The Travellers are aware that activities that the Travellers may partake in as a consequence of using the Grand Prize might involve certain risks including (without limitation) the risk of property damage, personal injury, or death. The Travellers understand the nature and extent of these risks and agree to undertake any such activities at their own risk.
- Language: The official terms and conditions for this competition are those set out in the English-language version of these Terms. The Korean-language version of these Terms is provided for ease of reference only and shall not affect the interpretation or construction of these Terms. If there is any ambiguity, conflict of meaning, or other difference between the English-language and Korean-language versions of these Terms, the English-language version shall prevail.
- Taxes: The winner shall be solely responsible for the payment of any taxes that apply to, or arise from, his or her prize. The winner is advised to seek independent financial advice prior to accepting that prize.
- Governing law: This competition, and these Terms, shall be governed by New Zealand law and the courts of New Zealand shall have non-exclusive jurisdiction to hear and determine all issues and disputes which may arise in connection with this competition. Entrants submit to the jurisdiction of the New Zealand courts and agree that the New Zealand courts are a convenient forum in which to resolve any issue or dispute arising out of or in relation to this competition.
