Imagications competition terms and conditions

By completing and submitting an Entry, you the adult entering the Tourism New Zealand Imagications Competition (the ‘Competition’) in conjunction with a child (the ‘Entrant’) confirm that you have read, understood and agree to all of these terms (the ‘Terms’) and meet the eligibility requirements. By submitting an Entry, the Entrant accepts the Privacy Policy and Terms of Service of TNZ’s Website.

The promoter of the Competition is the New Zealand Tourism Board trading as Tourism New Zealand (‘TNZ’), Level 1, 1 Nelson Street, Auckland, New Zealand. The Competition is being run with the support of Discovery NZ Limited (‘Discovery’). The Competition will be conducted through TNZ’s website [www.newzealand.com/nz/campaign/imagications] (‘TNZ’s Website’). TNZ reserves the right to cancel the Competition or to change any Term of the Competition (in any way it deems fit), without notice.

  1. Entry and Winning:
    a) To enter the Competition, an Entrant must complete an entry by uploading a Child’s drawing that complies with these Terms (‘Drawing’) via the Competition submission portal on TNZ’s Website; and filling out the required details on the entry form of the submission portal on TNZ’s Website in respect of the corresponding Child’s Drawing, and accept these Terms and TNZ’s Privacy Policy (‘Entry’). If an Entrant does not provide accurate information in the Entry, TNZ may determine such Entry ineligible to participate in the Competition.

    b) Entries submitted by any means other than as set out at clause 1 of these Terms will be invalid and will not be accepted. If an Entrant fails to comply with any of the Terms, any Entry submitted by such Entrant will be void. An Entry must be made by an adult eighteen (18) years of age or older in conjunction with each Child, one Drawing per Entry, but multiple Entries will be permitted by Entrants (provided a different Drawing is submitted each time). The adult Entrant must be a New Zealand resident and not an employee or contractor (or an immediate family member of an employee or contractor) of TNZ, Special Group Limited, Toybox Limited or Stanley Street Limited. Entries must be submitted between 29 August 2022 and midnight 16 October 2022 (the ‘Entry Period’).

    c) Each Drawing submitted with an Entry must be completed by a child aged 12 years old and under (‘Child’); indicate what that Child’s dream vacation in New Zealand would be, be the Child’s original work and comply with these Terms.

    d) The five (5) winners of the prizes set out at clause 2 of these Terms (the ‘Prizes’) (the ‘Prize Winners’) will be the five (5) Entrants whose Child’s Drawings entry is chosen by random draw by TNZ in its sole, exclusive and final discretion.

    e) TNZ and/or a supplier of the Prizes (‘Supplier’) will endeavour to contact the Prize Winners using the details provided to TNZ in their Entry form, within two (2) business days of their Drawing being drawn as a Prize Winner. In order to claim their Prize, the Prize Winners must, within 72 hours of TNZ or a Supplier’s first attempted communication with the Prize Winners, respond to TNZ or the Supplier in the manner instructed by TNZ or the Supplier and provide any information requested by TNZ.

    f) Prize Winners agree to be contacted by TNZ and/or any of the Suppliers for the purposes of arranging the supply of the Prize.

    g) Prize Winners agree that their entry may be used on Social media channels to promote the competition during the competition dates.

    h) TNZ’s decisions are final and no further correspondence will be entered into.

    i) TNZ assumes no responsibility for any error, omission, interruption, deletion, defect, failure, malfunction, alteration, delay in delivery, operation or transmission, or other circumstance of any kind, which may affect an Entry or an Entrant’s participation in the Competition. TNZ reserves the right to verify the validity of Entrants and Entries.
  2. Prizes: There are a total of five (5) Prizes to be won:
    a) The main Prize consists of one (1) House of Travel voucher with a value of NZ$5,000 to be drawn at random from all entries received at the end of the Entry Period. 

    b) There will be Four (4) runner up prizes that consist of House of Travel vouchers with a value of NZ$1,000 each, from all entries received at the end of the Entry Period. 

    c) The Prizes are solely limited to spending on domestic transport, accommodation, and any other incidental New Zealand holiday costs. It is the responsibility of the Prize Winners and Travellers to organise the experience, transport and accommodation with the House of Travel team they are put in touch with. 

    d) The Prize must be used by the winning Entrant and Child and additionally any person who uses the Prizes, including the Prize Winners and their chosen family members (if any), is referred to as a ‘Traveller’. All Travellers must agree to these Entrant Terms (where applicable to them) as a condition of using the Prizes. If required by TNZ, or any of the Suppliers, a Traveller must sign any further terms and conditions, agreement or acknowledgement, including (but not limited to) a code of conduct.

    e) The Prizes must be used within twelve (12) months of the end of the Entry Period and no compensation will be payable if a Prize Winner is unable to use the Prizes within this period. The Prizes may only be used domestically within New Zealand. No part of the Prizes can be transferred, exchanged or redeemed for cash. All other expenses additional or incidental costs associated with receiving and using the Prizes are the sole responsibility of the Prize Winner and Travellers (where relevant). TNZ is not responsible for any use of the Prize, including without limitation availability, any cancellation, delay or rescheduling, and any costs incurred as a result (including, without limitation, travel, and accommodation costs) will be the sole responsibility of the Prize Winner. The Prizes may not be passed on or gifted for the benefit of anyone else except the Prize Winners and the Travellers.

    f) The Prizes will be subject to standard booking conditions and additional terms and conditions in relation to the supply of those goods and services. By entering the Competition, and accepting the Prize, each Entrant agrees to such terms and conditions.
  3. Intellectual Property: By submitting an Entry, each Entrant assigns and thereby relinquishes, all intellectual property rights (including but not limited to, copyright) and all proprietary rights whatsoever, to the original Entry (including moral rights) exclusively to TNZ and grants to TNZ an exclusive, royalty free perpetual worldwide licence to use any such copyright and other intellectual property rights in any and all media to the extent TNZ deems appropriate. The Entrant confirms and warrants:

    a) Each Drawing submitted with an Entry is the nominated Child’s original work and does not infringe any copyright or any other rights of any third party.

    b) The Entry is not obscene, defamatory, libellous, threatening, harassing, hateful, racially or ethnically offensive, or encouraging of conduct that would be considered a criminal offence, gives rise to civil liability, or violate any law.

    c) The Entry does not contain viruses or other computer programming routines that may damage, interfere with, surreptitiously intercept or expropriate, any system, data or personal information.

    d) TNZ (and all of its partners, subcontractors or Suppliers), may publish any Entry in perpetuity and in all media now known or later invented. This includes, without limitation, websites owned or controlled by TNZ or associated with this Competition, or as determined by TNZ at its sole discretion, and on TNZ’s Instagram, TNZ’s Facebook, TNZ’s YouTube and TNZ’s Twitter accounts.

  4. Publicity, Contact and Minimum Standard of Behaviour: In order to participate in this Competition, receive and use the Prizes, Entrants and Travellers must:

    a) Consent to their names, photograph, Drawing,  image and likeness being recorded, reproduced, published, copied, communicated and otherwise used by TNZ and any of the applicable Suppliers for advertising, publicity and promotional purposes in any television programme, video recording, or printed or electronic materials throughout the world, in perpetuity, and without the need for any compensation other than the Prize (if applicable);

    b) Agree, not without the specific prior written consent of TNZ, to publish or disclose any information in connection with the Competition or the Prize (in particular, without limitation, to a representative of the media, in whatever form). No person may give interviews or be involved in articles or reports regarding the Competition or the Prize with any third party without the specific prior written consent of TNZ.

  5. Governing Law, Limitation of Warranties and Liability: The Competition and these Entrant Terms shall be governed by the laws of New Zealand. To the maximum extent permitted by law, TNZ (its associated entities, employees, contractors and agents), and any of the suppliers of the Prizes:

    a) disclaim all guarantees, warranties, and representations of any kind in respect of the Competition, the Prizes, and the claiming and use of the Prizes;

    b) exclude any and all liability for any loss (including damage, claim, injury, cost or expense) which is suffered or incurred by an Entrant in connection with the Competition or Prizes;

    c) will not be responsible for any events beyond their reasonable control, including unforeseen closures or restrictions due to natural disasters, unexpected weather conditions, Covid 19 or any other pandemic. To the extent an event beyond the reasonable control of TNZ or a Supplier occurs, the timetable for this Competition and related promotions may be modified by TNZ.
  6. Privacy: Personal information provided by each Entrant will be collected, stored and used by TNZ for the purpose of conducting the Competition and related promotions as contemplated in these Terms. The collection, use and disclosure of personal information provided in connection with the Competition is governed by TNZ’s privacy policy (found here https://www.newzealand.com/nz/utilities/privacy-policy/). You may have rights of access to and correction of your personal information under the Privacy Act 2020.
