Entry Restrictions 

Entry is open to any person (Entrant) that is a permanent resident of Australia over 18 years of age, subject to the following restriction: 

Employees (and their immediate families) of the Promoter, Partners, and any agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. 

Entry Procedure  

To enter the Promotion, an Entrant must complete the submission form at https://newzealand.com/au/campaign/mermaids-win (Competition Webpage) during the Promotion Period, by: 

  • submitting their full name, email address, and postcode; 
  • signing up to the 100% Pure New Zealand mailing list; 
  • confirming acceptance of these Competition Terms and Conditions, the Promoter’s Privacy Policy, and the Promoter’s Website Terms of Use; and 
  • completing any other required details on the submission portal.

Draw Process: The first valid entry randomly drawn from all entries received during the Promotion Period (the Prize Winner) will receive the Prize. There is one Prize available in the draw and no bonus prizes will be awarded. 

Prize 

The Prize consists of the following components: 

  • Return economy class flights to Auckland, New Zealand for one person, from the Prize Winner’s nearest capital city (up to NZ$1,500); 
  • 3x nights’ accommodation in Northland, New Zealand (up to NZ$1,200);

The Prize can only be redeemed for travel during the Prize Period, unless otherwise agreed by the Promoter, at their sole discretion.

The total value of the Prize is approx. AU$7,600 as at the date of publishing these Competition Terms and Conditions. 

Notification 

The Prize Winner will be notified by email one (1) business day after the Draw.  

Claim Process 

To claim the Prize, the Prize Winner must confirm acceptance via reply email during the Prize Claim Period. Entrants should check their junk and spam email folders. The Promoter will not compensate a Prize Winner who fails to claim the Prize due to the notification going to their junk or spam folders. 

Prize Claim Period  

The Prize must be claimed within fourteen (14) days of the Notification.

Terms and Conditions 
 

1. Overview 

 1.1 These Terms and Conditions incorporate and must be read together with the Schedule for the Promotion (together, the Competition Terms and Conditions). The Schedule prevails to the extent of any inconsistency with these Conditions of Entry.  

 1.2 Capitalised terms in these Terms and Conditions have the meaning given in the Schedule, unless stated otherwise. 

 1.3 These Terms and Conditions are binding between any person participating in the Promotion (“you”) and the Promoter (“we”, “us”). 

 1.4 The Promotion will be conducted through the Competition Webpage. The Promoter reserves the right to cancel the Promotion or change any of these Competition Terms and Conditions, subject to the approval by relevant authorities, if required. The Promoter will announce any cancellation or modification to the Promotion via the Competition Webpage. 

2. Conditions of Entry 

2.1 To enter the Promotion, Entrants must complete the Entry Procedure during the Promotion Period. 

2.2 Entry is open to permanent residents of Australia who comply with the Entry Restrictions.  

2.3 Entrants can only enter the Promotion once. 

2.4 Entries submitted by any means other than as set out by the Entry Procedure will be invalid and will not be accepted. If an Entrant fails to comply with any of these Terms and Conditions, an Entry submitted may be invalid. If an Entrant does not provide accurate personal information in the Entry, the Promoter may determine such Entry invalid. 

2.5 The Promoter reserves the right, at any time, to verify the validity of entries and entrants and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. The Promoter reserves its rights to recover damages or other compensation from such a person. Errors and omissions in the Entry Procedure may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 

2.6 In accordance with the Entry Procedure, by entering the Promotion you acknowledge that the Prize Winner’s participation in certain components of the Prize will be subject to special conditions, as outlined at cl 4.7 below. 

2.7 In accordance with the Entry Procedure, by entering the Promotion, Entrants consent to receive commercial electronic messages from the Promoter through the 100% Pure New Zealand mailing list. You also consent to receiving any electronic messages containing updated information in relation to the Promoter’s news and various other information of related interest. You may unsubscribe at any time to receiving such messages by following the unsubscribe process specified in any such electronic message that you receive. 

2.8 If this Promotion is not capable of running as planned for any reason (including but not limited to failure or malfunction of any computer equipment by reason of infection by computer virus, power failure, bugs, tampering, unauthorized intervention, fraud, or technical failures or any other causes which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right in its sole discretion to disqualify any individual who undermines the integrity or fair running of the Promotion for other entrants, including by tampering with the entry process, and, after consulting with the relevant legislative authorities, to cancel, terminate, modify or suspend the Promotion. 

 3. Competition Draw and Prize Claim 

3.1 The Prize Winner will be selected in accordance with the Draw Details. 

3.2 If required by any relevant authority, a scrutineer will be appointed to confirm that the processes followed by the Promoter provide reasonable assurance that all persons who are entitled to participate in the Promotion are entered and that the Promotion is fair. Where a scrutineer has been appointed, in the event of a dispute, the scrutineer will act as adjudicator and their decision will be final and no correspondence will be entered into. 

3.3 The Promoter will make every reasonable effort to contact the Prize Winner using the details provided in accordance with the Entry Procedure, within 72 hours of the Draw. 

3.4 The Prize may only be claimed if in accordance with the Claim Process during the Claim Period. 

3.5 If the Prize is not claimed in accordance with the Claim Process during the Claim Period, and the Promoter has made all reasonable attempts to contact the Prize Winner, the Prize Winner may be redrawn in accordance with the Unclaimed Prize Redraw Details. 

3.6 Unsuccessful Entrants will not be contacted. The Promoter’s decision is final and no further correspondence will be entered into.  

3.7 The Promoter will share the Prize Winner’s name and email address with its Partners for the purposes of arranging the supply of the Prize. The Prize Winner agrees to be contacted by the Promoter and/or the Partners for this purpose. 

3.8 The Prize Winner’s last name, initial of first name, and postcode will be published online for a minimum of 28 days, in accordance with the Publication Details and the Replacement Prize Winner Publication Details (if applicable). The Prize Winner may request that their postcode not be published. 

3.9 The Promoter and its Partner assumes no responsibility for any error, omission, interruption, deletion, defect, failure, malfunction, alteration, delay in delivery, operation or transmission, or other circumstance of any kind, which may affect an Entry or an Entrant’s participation in the Promotion. The Promoter reserves the right to verify the validity of any Entrant and Entry. 

4. Prize and Special Conditions 

4.1 There is a total of one (1) Prize to be won, as specified in the Schedule. The Total Prize Pool for the Promotion is specified in the Schedule. 

4.2 The Promoter will contact the Prize Winner to arrange the dates of travel. To redeem the Prize, the Prize Winner must be available for travel during the Prize Period, or another period as approved by the Promoter. The Promoter will not be liable to pay any compensation if a Prize Winner is unable to redeem the Prize, or any part of the Prize, due to their own unavailability to travel during the Prize Period.  

4.3 Travel dates and participation in certain components of the Prize are subject to the availability of flights, accommodation, and Partner services. Availability may also be limited at certain times due to special events held in New Zealand, including public holidays. The Promoter is not required to compensate the Prize Winner where the Prize Winner’s ability to redeem any component of the Prize is limited due to the availability of flights, accommodation, or Partner services, or any cancellation, delay, or rescheduling by a Partner or third-party airline or accommodation provider. 

4.4 Participation in certain components of the Prize may be subject to weather conditions. The Promoter is not required to compensate the Prize Winner where weather conditions restrict or prevent their participation in any component of the Prize. 

4.5 All other expenses additional or incidental costs associated with receiving and using the Prize are the sole responsibility of the Prize Winner (including airport transfers, room service, telephone charges, insurance, costs of medical evaluation, or other personal costs). Compliance with any travel or entry documentation (including passports and visas), health regulations, immunisations, or similar certifications, and related expenses, will be the sole responsibility of the Prize Winner. 

4.6 The Promoter accepts no responsibility for any tax or other financial implications to the Prize Winner that may arise from claiming the Prize. The Prize Winner should obtain independent financial advice in this regard (at their own expense).  

4.7 The PADI Discover Scuba Experience, Basic Mermaid Course and Advanced Mermaid Course involves recreational scuba diving and freediving activities (Diving Activities). These activities require good physical and mental health and there are a number of medical conditions which can be hazardous while diving. Special conditions and restrictions apply to a Prize Winner’s participation in these certain components of the Prize, as follows (the Special Conditions): 

a) No earlier than 30 days before participating in any Diving Activities, the Prize Winner must complete the ‘PADI Freediver Medical History Form’ (Annexure A to these terms) and the ‘Diver Medical Participant Questionnaire’ (Annexure B to these terms) (together, the Medical Questionnaires).. Subject to the Prize Winner’s responses to the Medical Questionnaire, they may be required to undergo an in-person medical evaluation by a physician before being permitted to participate in the Diving Activities, at their own expense. 

b) Before participating in the PADI Basic Mermaid Course, the Prize Winner must be able to swim at least 25 metres without swim aids, be able to float comfortably at the surface for at least 3 minutes, and be in good physical health. 

c) Before participating in the PADI Advanced Mermaid Course, the Prize Winner must be able to swim at least 100 metres without swim aids, be able to float comfortably at the surface for at least 10 minutes, and be in good physical health.  

d) Before participating in any Diving Activities, the Prize Winner must agree to any additional terms and conditions required by the Partners, including but not limited to any liability waivers. A copy of any additional terms and conditions can be requested directly from the Partners by contacting:

e) The Promoter and its Partners reserve the right to require satisfactory completion of any additional medical requirements prior to permitting participation, as are reasonable in the circumstances. 

4.8 If the Prize Winner is unable to comply with some or all of the Special Conditions, they will be unable to participate in the component/s of the Prize to which the Special Condition/s relates. The Prize Winner may still redeem the other components of the Prize, and may elect to transfer the component/s of the Prize they are unable to participate in to any one other person (the Transferee) by providing prior written notice to the Promoter, and provided that the Transferee is able to comply with the Special Conditions, and meets the Entry Restrictions.  The Transferee must also agree to clauses 4.2 to 4.7, 5 and 6 of these Competition Terms and Conditions, as if they were the Prize Winner. 

4.9 If the Prize Winner is unable to participate in any component of the Prize, including where they are unable to comply with some or all of the Special Conditions, and does not elect to transfer that component to another person, the Promoter is not obliged to replace that component of the Prize or otherwise compensate the Prize Winner.  

4.10 Unless transferred in accordance with cl 4.8, no part of the Prize can be transferred, exchanged, retained as credit, redeemed for cash, or gifted for the benefit of anyone else other than the Prize Winner, except for the Sealife SportDiver Underwater Smartphone Universal Housing, the Mermaid Sustainable Sea Beauty Kit, and the PADI Water Lovers Kit, which the Prize Winner is entitled to gift or re-sell. 

5. General 

5.1 The conduct of the Promotion and these Competition Terms and Conditions shall be governed by the laws of Australia. 

5.2 To the maximum extent permitted by law, the Promoter and its Partners (and their associated entities, employees, contractors, and agents): 

a) Disclaim all guarantees, warranties, and representations of any kind in respect of the Promotion and the Prize, including the claiming and use of the Prize.  

b) Exclude all liability for any loss (including damage, claim, injury, cost, or expense) which is suffered or incurred by an Entrant in connection with the Promotion or the Prize, whether direct, indirect, special or consequential. 

c) Will not be responsible for any events beyond their reasonable control, such as unforeseen closures or restrictions due to natural disasters, unexpected weather conditions, COVID-19 or any other pandemic. To the extent an event beyond the reasonable control of the Promoter or its Partners, the Promotion and Prize may be cancelled or modified by the Promoter in its sole discretion. 

Nothing in these Competition Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law being Schedule 2 to the Competition and Consumer Act 2010, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). 

6. Privacy 

6.1 The collection, use and disclosure of personal information provided in connection with the Promotion is governed by the Promoter’s Privacy Policy. 

6.2 We may use your personal information for any purpose which is stated to you at the time of collection or that you otherwise authorise and to: 

a) store the information in any database controlled by the Promoter. 

b) verify your identity and to assist you if you forget your username or password for any of the services we provide to you via the Internet; 

c) communicate with you; 

d) analyse usage of this website; 

e) provide you with further information, news, and promotional material; 

f) carry out marketing, promotional and publicity purposes including direct marketing, market research and surveys; 

g) to show you advertising and information that is most relevant to you and your interests; and 

h) improve the content of this website and to customise this website to your preferences. 

6.3 We will not sell, rent, or lease your personal information to third parties. Your personal information will be made available internally for the above purposes and we may also disclose your personal information to trusted third parties or subcontractors, who have agreed to treat your personal information in accordance with this privacy policy, for similar purposes. Because we operate internationally, the recipients referred to above may be located outside the jurisdiction in which you are located. Your personal information may be transferred to, stored, and processed in New Zealand and other countries that are regarded as ensuring an adequate level of protection for personal information. 

6.4 We will only use or disclose personal information that you have provided to us, or which we have obtained about you for the above-mentioned purposes, or: 

a) if you have authorised us to do so; 

b) if we believe that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for national security in the performance of their functions; 

c) if we believe that the use or disclosure is reasonably necessary to enforce any legal rights we may have, or is reasonably necessary to protect the rights, property and safety of us, our customers, or others; or 

d) if we are authorised, required or permitted by law to disclose the information. 

6.5 You may have rights of access to and correction of your personal information under the Privacy Act 2020.
